DrinkSpy
Terms of use
Last updated 30 October 2026.
These terms apply when you use the DrinkSpy app and website ("the service"). By using the service, you agree to them. If you don't agree, please don't use it. Our privacy policy explains how we handle your information.
1. Who we are
DrinkSpy is operated by Treadstone Systems Limited, a New Zealand company (company number 9469560, NZBN 9429054062214). "We" and "us" mean that company. You can contact us at support@drinkspynz.co.nz.
2. You must be 18 or over
The service is for people aged 18 and over in New Zealand. By using it, you confirm that you are 18 or over.
3. What DrinkSpy does
DrinkSpy compares the prices of drinks at New Zealand stores and shows bars, pubs and clubs, and the happy hours, drink deals and events at them and at some restaurants. We don't sell or supply alcohol. To buy a drink, you deal with the retailer, under the retailer's own terms. We are not part of, or endorsed by, any retailer or venue. Their names and trademarks belong to them, and product photos and details are shown with the retailers' permission.
4. Prices can be wrong or out of date
Prices come from retailers' websites and from reports by people using the app. They are collected regularly, from every night to about once a week depending on the retailer. A price can be out of date, differ in store or at checkout, or leave out promotions, membership prices or delivery costs. Please check with the retailer before you buy. We work to keep prices accurate, but we aren't responsible for a retailer's prices or for decisions you make relying on them, except as section 14 says.
5. Going out
Going out is a test feature and may change or stop. Its list of bars, pubs, clubs and restaurants comes from OpenStreetMap and may be incomplete or out of date, and a venue may have closed. How busy a venue is comes from what other people report, so it may be wrong. Happy hours and drink deals come from venues' own websites and from people using the app; a venue can change or end a deal at any time, so check with the venue before you go. Venues decide who they let in and what they charge. Showing a venue or a deal doesn't mean we recommend it.
6. Drink responsibly
Never drink and drive, and plan a safe way home. Ride options in the app open other companies' services, under their own terms. For free, confidential support with alcohol, call the Alcohol Drug Helpline on 0800 787 797.
7. Your account
You need an account to add venue photos. If you create one, give your real name and an email address you use, keep your password private, and don't share your account. If you sign in with Apple or Google, their terms also apply to that sign-in. You are responsible for what is done through your account. You can delete it in the app at any time. We may suspend or close an account that breaks these terms.
8. Reports you send
Price reports, busy reports and deals must be honest and come from what you have seen yourself. Only send a busy report while you're at the venue. A deal shows its price and times only (for example "$8 house pints"): don't describe it as a percentage off, half price, free or unlimited, because New Zealand law restricts advertising alcohol that way. If you own or work at a venue, don't report on it to mislead people. Don't put personal information in a price report's note. You let us use, show, combine and keep your reports as part of the service, free of charge. We may review reports and remove any that seem wrong or misleading.
A photo you add must be one you took yourself, of the venue. Don't include people who could be recognised without their permission, anyone under 18, or wording that promotes discounts or free drinks. You keep the rights to your photo and let us show it in the service, free of charge. We check photos before they appear and may remove any at any time.
To send an update about a venue, you must own or manage it, or be allowed to act for it, and what you send must be true. Deals and events in an update follow the same wording rules as other deals. We check every update before anything changes on the venue's page, and we may decline it or edit it. You let us use what you send in the service, free of charge.
9. No reverse engineering and no scraping
You must not, and must not help or allow anyone else to:
- reverse engineer the app or the service: decompile, disassemble, decrypt or take it apart, try to work out its source code, how it works or how it talks to our servers, or copy, change or make products based on it;
- scrape or extract data: copy, collect, harvest, download, index or store prices, products, stores, venues, busy levels, reports or any other data from the app, our website or our servers, whether by bots, scrapers, crawlers, scripts or other automated tools, or by copying it by hand in bulk;
- access our servers or API other than through the app or website as we provide them, or use them for another app, website, database or service;
- use data from the service to build, train or supply a competing product, database or dataset;
- get around or interfere with anything we use to protect the service, such as rate limits or access controls.
This applies except where the law expressly allows it despite these terms. If you break this section, we may block your access, close your account and take legal action.
10. Using the service fairly
Please don't:
- overload, disrupt or try to get unauthorised access to the service;
- send false reports, or create extra accounts or reset the app to get around limits;
- use the service for anything illegal.
11. Our content and others'
The app, its design and our compilation of prices belong to us. You may use them for your own personal, non-commercial use. Venue information is © OpenStreetMap contributors, available under the Open Database Licence. Maps come from Apple, Google or OpenStreetMap. Retailers' names, trademarks and photos belong to the retailers. Venue photos marked Google Maps belong to the people credited and are shown through Google Maps.
12. Other services
The service links to other services, such as retailers' websites, map apps and ride apps. Their own terms and privacy policies apply when you use them, and we aren't responsible for them.
Some venue photos, the address suggestions and the routes to stores come from Google Maps. By using DrinkSpy you also agree to the Google Maps/Google Earth Additional Terms of Service, which include the Google Terms of Service, for that content.
13. Changes to the service
The service is free. We may change, pause or stop any part of it, including test features, at any time. We don't promise that it will always be available or free of errors.
DrinkSpy is in beta, shared with testers through Apple's TestFlight. Features may change and there may be bugs. Please report any problems to support@drinkspynz.co.nz.
14. Your consumer rights and our liability
Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that can't be excluded. Subject to that:
- the service is provided as it is;
- we aren't liable for any loss that comes from inaccurate prices, venue details, deals or busy reports, or from the service being unavailable;
- we aren't liable for any indirect or consequential loss; and
- our total liability to you for anything to do with the service is limited to NZ$100.
If you use the service for the purposes of a business, the Consumer Guarantees Act 1993 does not apply.
15. App Store and Google Play
If you downloaded the app from Apple's App Store, Apple's Licensed Application End User License Agreement also applies to your use of the app, and Apple isn't responsible for the app or its support. If you downloaded it from Google Play, Google Play's terms also apply. If you test the app through Apple's TestFlight, Apple's TestFlight terms also apply.
16. Changes to these terms
We may update these terms. When we do, we'll change the date at the top, and we'll tell you in the app about significant changes before they take effect. If you keep using the service after a change, you accept the updated terms.
17. Law
These terms are governed by New Zealand law, and the courts of New Zealand can hear any dispute about them.
